Welcome to Cineplex Entertainment LP’s “mycineplex Avatar” online contest (“Contest”).
By entering this Contest, you acknowledge that you have read, understood and accept the terms and conditions below, as well as the mycineplex Terms of Membership.
Sponsor: Cineplex Entertainment LP (“Cineplex”) is the sole sponsor (“Sponsor”) of this Contest and is responsible for conducting and administering this Contest.
1. How to Enter:
No purchase necessary. mycineplex Avatar Contest (the “Contest”) begins at 12:01 PM E.T. on Friday August 21st, 2009 and ends at 9:00 AM E.T. on Tuesday December 1st, 2009 (“Contest Period”). To enter the Contest, mycineplex members that have already created a screen name must go to http://www.cineplex.com/Contests.aspx and click on the “mycineplex Avatar” link, then follow the instructions.
If you are not a member of mycineplex or are a member but have not yet created a screen name, you must complete or update your registration by going into your account and creating a screen name at http://www.cineplex.com/Global/MyAccount/CreateAnAccount.aspx.
Once you have a screen name, go to http://www.cineplex.com/Contests.aspx and click on the “mycineplex Avatar” link and follow the instructions.
To qualify for the screening tickets, you must tell us what you would do if you had this brain linking apparatus and could have your own real life Avatar. Your explanation can include a name, how your avatar would look, and what their skills would be. The more creative your answer is, the better your chance of winning. Entries must meet the following conditions:
- Entry must comply in all respects with the mycineplex Terms of Membership, which are incorporated into this document by reference;
- Entry must be an original work of the entrant, and must not infringe on the copyright, moral rights, personality rights, or any other rights of any third party; and
- Entry, including its title and description, must be in keeping with the corporate images of the Sponsor, and must not contain any offensive, obscene, immoral or illegal depictions, to be determined at Sponsor and Contest Judge’s (defined below) sole discretion.
The odds of winning will depend on the total number of eligible entries received during the Contest Period, and the skill of the entrant in creating an Entry to satisfy the Judging Criteria set out in Rule 3 below. Only one (1) entry per natural person, screen name and per email address allowed during the Contest Period. Proof of submission does not constitute proof of receipt. In the event the Sponsor discovers attempts at multiple entries by one person using the same or multiple email addresses, each entry will be void and the entrant disqualified at the sole discretion of Sponsor. By submitting an Entry, entrants grant to Sponsor and/or Administrator a royalty-free, perpetual, non-exclusive, irrevocable, unrestricted, worldwide license to: (a) use, reproduce, store, adapt, translate, modify, make derivative works from, transmit, distribute, publicly perform or display such Entry for any purpose via all forms of media now known or hereafter devised; and (b) to transfer or sublicense to third parties the unrestricted right to exercise any of the foregoing rights.
2. Prizes:
The prize consists of a reserved row for you and friends to the opening day of the film Avatar.
Approximate retail value of each prize is $160.00 Cdn. Number of seats won is determined by theatre chosen after winner is contacted.
Winner is responsible for transportation to and from the preview screening. All Prizes are subject to change and can be substituted at the sole discretion of the Sponsor.
General Prize Conditions: Prizes must be accepted as awarded, are not transferable, non-refundable, and cannot be substituted or exchanged for cash, or any other prizes. The Sponsor reserves the right, at its absolute discretion, to make substitutions of equivalent kind or monetary value in the event of unavailability of all or part of any of a prize for any reason whatsoever. If there is any advertising that is inconsistent with the rules, the rules apply and we are not responsible for the advertising errors.
3. Selecting winners:
Prize Judging:
All valid entries received will be judged by the Cineplex.com editorial team. The potential winner will be selected as the best entry. Judging will be based on the best reasons given for what kind of Avatar you would have if possible. Your explanation can include a name, how your avatar would look, and what their skills would be. The more creative your answer is, the more likely you are to win. Judging will take place on Friday December 4th, 2009. Refer to ‘User submissions‘ in the Terms of Membership.
The Sponsor will attempt to contact the selected potential winners by email, once during business on Monday December 7th, 2009. The email communication will include instructions regarding where and when to redeem the prize and any other instructions regarding the special preview screening. Winners’ names will be added to a guest list supplied to the selected Cineplex Entertainment Theatres. Winners will pick up their passes at their designated theatre as indicated at the time of entry.
4. Eligibility:
Contest is open to legal residents of Canada (excluding Nova Scotia, New Brunswick, Newfoundland, Prince Edward Island, North West Territories, Nunavut, and the Yukon), who are over the age of majority in the province [or territory] in which they reside as of Friday August 21st, 2009. Attendees must meet film classification admission requirements. Seating is limited and is on a first come first served basis. Sponsor reserves the right to verify the age of potential prize winners and that such persons are not employees (or domiciled with employees) of any Related Parties. Void where prohibited. Contest is not open to: (a) employees of the Sponsor, the Administrator, the Judging organization, or any of their respective parent, subsidiary or affiliated companies, licensees, advertising and promotional agencies (“Related Parties”) or other suppliers of goods or services related to the Contest; or (b) members of the immediate family (defined as parents, siblings, children or spouses, regardless of where they reside) of such employees; or (c) those with whom such employees are domiciled (whether related or not). Void where prohibited. Mycineplex members must maintain their membership for the duration of the Contest Period.
5. General Rules:
The Sponsor shall not be liable for lost, late, incomplete, garbled, misdirected, not received, stolen, mutilated, or illegible entries. By entering this Contest, entrants accept and agree to be bound by these Official Contest Rules and the decisions of the Sponsor, the Contest Judge and independent judging organization, if any, which are final, binding and conclusive on all matters relating to this Contest. All Entries become the property of the Sponsor and none will be returned. No correspondence will be entered into except with selected entrants who will be notified by email or telephone. The Sponsor reserves the right to disqualify all entrants who fail to comply with these Official Contest Rules or who make any misrepresentation relating to the Contest, drawing and redemption of the prizes. This Contest is subject to all applicable Federal, Provincial and Municipal legislation.
The Sponsor shall not be responsible for any failure of the website during the Contest Period or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible due to technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer or property related to or resulting from playing, downloading, or uploading any material in the Contest.
The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the “Régie”) in the Province of Québec, to terminate or amend this Contest at any time and in any way, without prior notice and conduct a random draw from all previously received eligible entries. The Sponsor reserves the right, at their sole discretion to cancel or suspend this contest should a virus, bug or any other cause beyond the reasonable control of Sponsor corrupt the security or proper administration of the contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.
Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry name change. The sole determinant of the time for the purposes of a valid online entry in this Contest will be the contest server machine(s).

6. Privacy:
By entering this Contest, entrants consent to the use of their personal information by Sponsor, Administrator and their respective authorized agents for the purpose of administering the Contest and fulfilling prizes. At Cineplex, we are committed to respecting your desire for privacy. Any personal information that we gather will be handled in strict accordance with our privacy policies and all applicable privacy legislation. Cineplex will not sell your personal information collected for this contest to any third parties. Any personal information collected for this contest shall be used by Cineplex as is disclosed herein. Please note that by submitting personal information to Cineplex, you consent to our use as described herein http://www.cineplex.com/Global/PrivacyPolicy.aspx.
By accepting a prize, winners consent to the use of their name, address (city/province), photograph or other image, voice and/or statements by Sponsor, Administrator and their respective authorized agents for the purposes of advertising and promotion in any media without further notice or compensation.
7. No Liability:
Sponsor shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, any prize awarded in this Contest or the events forming part of this Contest.
