BIRTHDAY PARTY SURVEY CONTEST (the “Contest”)

By entering this Contest, you acknowledge that you have read, understood and accept the terms and conditions below.

Sponsor: Cineplex Entertainment LP (“Sponsor”) is the sole sponsor of this Contest.

THE PRIZE:

One (1) prize (the “Prize”) of One (1) Great Escape Certificate and Two (2) Child Adventure Certificates will be awarded (Approximate retail value: $66). Each Child Adventure certificate is valid for one child’s admission ticket and one mini combo (“Concession Item”), and is redeemable for children ages 13 and under only. The Great Escape certificate is valid for two general admission tickets, two regular soft drinks and one regular popcorn. The movie ticket portion of the certificates are redeemable at all Cineplex theatres, online at Cineplex.com and the Cineplex mobile app. If the movie ticket portion of the certificates are redeemed online, a booking fee up to $1.50 per certificate, which allows for advanced online seat reservations, and provides sharable digital tickets, will apply. Certificates (a) are not valid for non-feature film or Event Cinema performances; (b) cannot be combined with any other voucher or offer; (c) may be applied towards the purchase of a premium admission ticket, including but not limited to, in IMAX®, 3D, DBOX, 4DX, UltraAVX®, VIP (must be legal drinking age), ScreenX and Kids Clubhouse auditoriums with the payment of an applicable surcharge per certificate; (d) may not be re-sold without the written consent of Cineplex; and (e) are valid for earning Scene+ä points. Additional conditions apply. The Prize will be mailed to the winner shortly after the completion of the verification process.

All other costs and incidentals not specified to be part of the Prize, including but not limited to all taxes (where applicable), are the winner’s responsibility.

The Prize is not transferable without the Sponsor’s written consent, and cannot be substituted by winner for cash or otherwise and must be accepted as awarded. The Sponsor reserves the right, in its absolute discretion, to make substitutions of equivalent kind or value, including issuing a cash prize in the amount of the approximate retail value stated above, in the event of unavailability of all or part of the Prize for any reason whatsoever.

HOW TO ENTER

No purchase is required. Contest begins April 25, 2025 at 12:00:01AM and ends at 11:59:59 PM E.S.T. on May 4, 2025 (“Contest Period”).

To enter, you must click on the survey link offered in the invite emailed to you, complete the full survey, accept the contest rules and regulations and provide an email address. You must be an original recipient of the Birthday Party Survey email invite and have completed the full survey. Individuals who have been forwarded the Birthday Party Survey are not eligible to enter.

To enter the contest without completing the survey send your name, full mailing address (including city, province, postal code), email address and a handwritten 50 or more word essay about your Cineplex birthday party experience (the “Essay”), in a postage paid envelope bearing sufficient postage to “Cineplex Birthday Party Survey Contest”, c/o Cineplex Entertainment LP, 1303 Yonge Street, Toronto, ON, M4T 2Y9. Entry must be post-marked by May 4 2025, and received no later than May 8, 2025. Each entry must be unique and mailed in a separate envelope bearing sufficient postage. The odds of winning depend on the number of eligible entries received during the Contest Period.

ELIGIBILITY:

The Contest is open to legal residents of Canada who are eighteen (18) years of age or older and who booked a birthday party at a Cineplex theatre, Playdium or The Rec Room location between April 1, 2025 and April 25, 2025. You are not eligible if you are (or you live with) an employee, representative, or agent of the Sponsor or any of its affiliated companies or licensees (collectively, the “Related Parties”). Sponsor reserves the right to verify the age of potential prize winner and that such person is not an employee of or domiciled with an employee of the Related Parties. Void where prohibited.

THE DRAW:

At approximately 1:00 PM on May 9, 2025, a random draw will be held in Toronto, Ontario to select the potential Prize winner. The potential winner will be selected from all eligible entries received during the Contest Period. The Sponsor will attempt to contact the potential Prize winner by email. If the selected entrant cannot be reached within three business days after the date of the draw or after three attempts to contact, whichever comes first, the selected entrant will no longer be eligible to win the Prize and Sponsor shall have the right to choose another entrant from the remaining eligible entries. This process shall continue until the Prize winner is selected. If you are eligible to be a Prize winner, you must correctly answer unaided, a mathematical skill-testing question. The potential Prize winner must sign a declaration and release form discharging and releasing the Sponsor and their partners, parent, subsidiary or affiliated companies, officers, directors, shareholders, or employees from any and all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or nonuse of the prize they are eligible to win or parts thereof; confirming compliance with the Contest rules and acceptance of the Prize, as awarded (a “Declaration and Release Form”). The Declaration and Release Form must be signed and returned to Sponsor within 14 days of receipt. If the Declaration and Release Form is not returned within 14 days of receipt, the potential winner will be disqualified and an alternate potential winner may be randomly selected from the remaining eligible entries received.

OTHER RULES:

By entering, contestants agree to abide by these Contest rules and all decisions of the Sponsor will be final and binding on all entrants. This Contest is subject to all applicable Federal, Provincial and Municipal Laws.

The Sponsor shall not bear any liability for (a) entries which are incomplete (or otherwise improperly completed), delayed or destroyed as a result of failure of the website or technical problems or traffic congestion on the Internet, (b) the loss, theft or misuse of the Prize, or (c) any property damage, personal injury or misfortune in any way attributable to this Contest or the Prize (including, in the case of on-line entries, injury or damage to any on-line systems, servers, access providers, computer equipment or software) or resulting from downloading any material from the Contest website.

No correspondence will be entered into except with the selected entrants who qualify to win the Prize. By accepting the Prize, the winner grants the Sponsor the right to use the winner's name, comments and/or city and province of residence, without further compensation, in any advertising or publicity. All entries become the property of the Sponsor who assumes no responsibility for any failure of the website during the promotional period, for any problems or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are obtained through fraudulent means or through an abuse of the Cineplex Birthday Party Survey Contest or in any way tampered with, forged, mutilated, illegible, incomplete or mechanically reproduced will, at the sole discretion of the Sponsor, be disqualified.

The Sponsor may cancel, suspend or modify this Contest or any portion hereof at any time or for any reason without further notice if any factor interferes with the proper conduct of the Contest, including, but not limited to, a virus, bug or any other cause of any nature beyond the reasonable control of the Sponsor corrupts the security or proper administration of the Contest.

Any personal information you provide by entering this Contest will be used only to administer this Contest, and for no other reason and at all times will be collected, used, stored and destroyed in strict accordance with Sponsor’s privacy policy (https://www.cineplex.com/Global/PrivacyPolicy?cmpid=FooterEN_privacy-policy)and all applicable privacy legislation. By entering this Contest you consent to the Sponsor contacting you should you be selected as a potential Prize winner. The responses to the survey questions that you provide will be used by the Sponsor in an aggregated manner only and will not be linked to your personal information.

No Liability: None of the Related Parties, or their respective parent, subsidiary or affiliated entities, or each party’s officers, directors or employees (collectively, the “Released Parties”) shall be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prizes awarded in this Contest or the events forming part of this Contest. By participating or accepting a Prize, all entrants release and hold harmless the Released Parties from any and all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or non-use of the Prize or parts thereof, and from liability to any other persons relating to or resulting from entering this Contest.

Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest or the Contest Rules or the rights and obligations as between the entrants and Sponsor in connection with the Contest shall be: (a) governed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws; and (b) resolved individually without resort to any form of class action. All parties hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Contest or the Contest Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario.

Language Discrepancy:  In the event of any discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, or of any contest materials or Declaration and Release Forms, the English version shall prevail, govern and control.
